很多外國人在車禍後,被告知不能離開台灣時,第一個反應是:「我都還沒被判有錯,為什麼不能走?」
這個問題其實很常見,但答案也很直接。
1. 這不是賠償問題,是刑事問題
你被限制出境,是因為主張你犯錯的人以你是外國人會離開台灣為由,要求法院限制你離境。
對方以「提出刑事告訴」的目的來要求賠償,他要錢:
法院以「你可能會離開台灣而發生無法處罰你」為由限制你離開台灣,法院不是在乎錢。
只要案件進入刑事程序,
檢察官或法院就可能限制你離境,確保你能配合後續調查或程序。
2. 解除限制,有兩條路
路徑一:和解
- 與對方達成協議
- 對方撤回告訴
- 限制解除
結論:速度快,但可能會發生「賠償不合理的數額」或是「你根本不用賠償但你仍舊賠了一筆錢」
路徑二:證明你沒有責任
- 等初判表
- 等交通事故鑑定
- 等由檢察官或法官判斷
結論:不一定需要賠償,但需要時間。初判表由交通警察大隊製作,於事發後1個月內完成;交通事故鑑定報告於「提出鑑定請求」後,最快1個月安排鑑定會議,於鑑定會議後1個月內取得車禍鑑定報告;檢察官或法官判斷,代表案件進入偵查程序或審理程序,每個程序,短則8個月,長則16~18個月。
3. 為什麼對方要把你留下來?
邏輯其實很簡單:
把你留在台灣 → 製造壓力 → 談賠償
如果你表現得很急著離開,你的談判能力會大幅下降。
但還有一個更現實的原因:
對方會擔心,你離開台灣就無法確保你履行賠償責任。
所以,把你留下來,同時是談判策略也是風險控管。
4. 你現在最不該做的事
表現出你「一定要離開」。一旦對方知道你有時間壓力,談判條件就會對你不利。
5. 正確的做法
你應該傳達的是:
我可以配合處理,不急著離開。
然後開始評估一件事:
- 留在台灣的成本
- 和解的成本
做一個「理性決定」,而不是情緒決定。
6. 時間其實是關鍵
在還沒有取得相關資料(例如初步資料或鑑定結果)之前:
這個案件很可能會拖至少一週以上。
而這段時間,通常就是談判會發生的階段。

Why Am I Restricted from Leaving Taiwan? How Can I Leave?
Many foreigners, after being involved in a car accident, are told they cannot leave Taiwan.
Their first reaction is usually:
“I haven’t even been found at fault. Why can’t I leave?”
This question is very common.
And the answer is actually quite straightforward.
1. This is not about compensation — it is about criminal procedure
You are being restricted from leaving Taiwan because:
The other party claims you may be at fault and, since you are a foreigner, you might leave Taiwan.
Based on that concern, they request the court to restrict your departure.
Their purpose in filing a criminal complaint is to seek compensation.
They want money.
However, the court’s concern is different:
The court is not concerned about money.
The court is concerned that you might leave Taiwan and become unavailable for legal proceedings.
Once the case enters the criminal process:
The prosecutor or the court may restrict your departure to ensure your presence during the investigation or trial.
2. There are only two ways to lift the restriction
Option 1: Settlement
- Reach an agreement with the other party
- The other party withdraws the complaint
- The restriction is lifted
Fast, but it may result in:
- Paying an unreasonable amount, or
- Paying even when you may not actually be liable
Option 2: Prove that you are not at fault
- Wait for the preliminary police report
- Wait for the official accident appraisal
- Wait for a decision by the prosecutor or judge
You may not need to pay, but it takes time.
Timeline:

Preliminary report → within about 1 month

- Hearing scheduled about 1 month after request
- Report issued about 1 month after the hearing

- Investigation or trial process
- Typically 8 months (minimum) up to 16–18 months
3. Why does the other party want to keep you in Taiwan?
The logic is simple:
Keep you in Taiwan → create pressure → negotiate compensation
If you appear eager to leave:
Your negotiation position becomes significantly weaker
But there is also a more practical reason:
The other party is concerned that if you leave Taiwan, they cannot ensure you will fulfill any compensation obligation.
So keeping you in Taiwan is:
- A negotiation strategy
- A form of risk control
4. The worst thing you can do right now
Show that you “must leave Taiwan”
Once the other party knows you are under time pressure:
The negotiation will turn against you.
5. The correct approach
You should communicate:
“I am willing to cooperate and stay if necessary.”
Then evaluate two things:
- The cost of staying in Taiwan
- The cost of settlement
Make a rational decision, not an emotional one
6. Time is the key factor
Before obtaining key documents (such as preliminary reports or appraisal results):
The case will likely take at least one week or more.
And this period is usually when negotiation happens.
